Yesterday, April 15th, I got a postcard from a federal EPA office in Seattle inviting me to a 'webinar' scheduled for April 10th, to discuss a new licensing requirement for recreational dredge operators in the Republic of Idaho. Of course, there was no postmark on the postcard, so I can't prove that it was mailed with the intention of arriving late, but then they do it this way routinely.
I own mining claims in Boise County. Up until this year, the only 'permission slip' required was a Recreational Dredge Permit issued by the Idaho Department of Water Resources. It allowed recreational prospectors to utilize a small dredge up to the nozzle diameter of 5" in streams 'open to prospecting'.
2013 is the first year that the Feds have made any such requirement in this Republic. Clearly, they have brow-beaten the state employees into 'cooperating' with them in this new federal property rights violation.
My property rights under the laws of the Republic of Idaho had been gradually curtailed by the Feds under the guise of protecting the 'bull trout' for years. If that wasn't bad enough, the feds are now threatening me and all other dredge permit holders with prosecution under federal law if we do not submit to the 'new federal rules'.
If there was a Constitutional Sheriff in Idaho City, he would require the feds to get approval from him before any enforcement action took place in the Republic of Idaho for any federal 'violation'. And if he were that Constitutional Sheriff which we seem to have lost, he would do his duty and refuse to let the feds harass me, or anyone else for not 'obeying' the rules of the feds.
In fact, he could stop the spotted owl usurpations, the bull trout usurpations, the mining development usurpations, and a host of other unauthorized activities that the feds are now permitted to get away with.
I do not know how to fight this at the moment, but this is a violation of the 9th and the 10th amendments to the US Constitution. There is absolutely no authority in the US Constitution for the very existence of the EPA, nor is there any such authority the feds to enforce any such 'LAW' in the Republic of Idaho.
The Constitutional Sherriff has the authority to stop all federal tyranny dead in its tracks. It is the duty of the Sherriff to protect the rights of the citizens of this Republic from federal tyrants.
May I urge the Tea Party to aggressively promote and support the election of Constitutional Sheriffs in all Counties of the Republic of Idaho. That single action can stop the feds in their tracks.
